Terms and Conditions of Service
By booking and submitting payment for any service (Full-Service Catering or Hot & Fresh Delivery) with Shrimps ("The Company"), you ("The Customer" or "You") agree to be bound by the following terms and conditions.
1. Booking, Payment, and Service Agreement
1.1 Confirmation of Booking
Your booking is not confirmed until Shrimps has received full payment online. The date and time reserved are secured only upon successful transaction and confirmation via email.
1.2 Pricing and Payment
All prices are listed in U.S. Dollars (USD). Full payment is due at the time of booking to reserve the date, time, and necessary resources. Prices are subject to change without notice, but the price confirmed at the time of your booking will be honored.
1.3 Menu and Substitutions
While we strive to provide the seafood listed in your selected package, all seafood is subject to availability and seasonal catches. Shrimps reserves the right to make suitable substitutions of equal or greater value if a specific seafood item is unavailable due to market conditions or unforeseen shortages. We will attempt to notify the Customer of any significant substitutions.
1.4 Allergies and Dietary Restrictions
The Customer is responsible for notifying Shrimps of any food allergies or severe dietary restrictions prior to the event date. While we take every precaution to prevent cross-contamination, we operate in a shared cooking environment and cannot guarantee an allergen-free environment (e.g., shellfish, dairy, gluten). Shrimps is not responsible for any allergic reaction or injury sustained from food consumption.
2. Cancellation and Refund Policy
2.1 Governing Policy: All cancellations and refund requests are governed entirely by the published Shrimps Cancellation and Refund Policy, which specifies the penalty schedule based on the number of days prior to the booked event.
2.2 Administrative Fee: All cancellations are subject to a non-refundable $50 administrative fee.
3. Full-Service Catering Specific Terms
3.1 Property Access and Compliance
The Customer is solely responsible for verifying that the rental property, condo, Homeowners Association (HOA), or event venue permits on-site catering services and cooking. If the Shrimps crew is denied access or if local regulations prohibit service on the event day, the booking will be treated as a customer cancellation under the 0–6 days schedule (No Refund or Credit).
3.2 Service Area and Travel Fee
Our listed service area is from Panama City Beach, FL, to Destin, FL. Shrimps reserves the right to charge an additional travel fee if the event location is outside our standard service radius or requires extensive logistical travel. This fee will be communicated and must be agreed upon prior to booking confirmation.
3.3 Weather and Rescheduling
Shrimps reserves the right to cancel or postpone any scheduled outdoor catering event due to severe, unsafe weather (including lightning, tropical storms, or hurricanes). No cash refunds will be issued for weather cancellations. Instead, The Company will offer a 100% Booking Credit valid for one year, or we will work with the Customer to reschedule to an available date. The Customer must provide adequate shelter for the cook and equipment in the event of light rain.
3.4 Liability Waiver and Hold Harmless Agreement
The Customer acknowledges that the catering service involves the preparation and serving of food at high temperatures, the handling of large cooking equipment, and the presence of seafood shells (a choking and slip hazard). The Customer agrees to indemnify and hold harmless Shrimps and its owners, employees, contractors, and agents from any and all liability, claims, losses, or damages arising from property damage or personal injury (including, but not limited to, food-related illness, burns, or slips) occurring at the event, except in cases of proven gross negligence or willful misconduct by The Company. The Customer assumes all responsibility for guests' actions and any damage to the catering site during the event.
4. Hot & Fresh Delivery Specific Terms
4.1 Delivery Times
Delivery times are estimates and Shrimps is not responsible for minor delays caused by traffic, weather, or unforeseen logistical issues. Our crew will notify the Customer if a delay is expected.
4.2 Designated Drop-Off
The Customer is responsible for being present at the delivery location at the scheduled time. If our crew is unable to deliver the order due to the Customer being absent, late, or unable to be reached, the food will be held for a maximum of 15 minutes. After this time, the order will be forfeited, and no refund or credit will be issued.
5. Website and Online Payment Disclaimers
5.1 Payment Security
All online payments are processed through a secure, third-party payment gateway. Shrimps does not store your credit card information. We are not responsible for any security breaches or issues arising from the use of the third-party payment processor.
5.2 Limitation of Liability
In no event shall Shrimps be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided, exceeding the total amount paid by the Customer for the service in question.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, and any disputes shall be resolved in the courts of Bay County, Florida.
